Shepard's Preview on Cases 


The Lexis® and Lexis+® services provides a Shepard's® preview on cases. The preview is located in the upper right corner of a full-text document and provides the following information:

  • Reason for Signal?
  • Appellate History
  • Citing Decisions
    Note: This section provides the number of cases associated with each signal.
    • For Example:
      • Caution
      • Positive (3)
      • Neutral (2)
      • Cited By (20)
  • Other Citing Sources
 

To view the full Shepard's Report, click the Shepardize® this document link below the preview. Click on one of the links in the preview to view the Shepard's report filtered to that item.

The Reason for Signal? can come from any Citing Decision that generates Warning (red), Questioned (orange), Caution (yellow), or Positive (green) signals.  The Reason for Signal? provides a link to the relevant passage to the first Citing Decision listed with that Shepard's signal or to the case information and treatment for the first level Subsequent Appellate History generating the signal. Citing Decisions are listed by court hierarchy.
 
Cases with Warning (red) signals generated by a publication status, such as California unpublished cases, do not have the Reason for Signal. Some older cases do not have the Reason for Signal.

When the Reason for Signal? is a Citing decision, clicking the link opens a window with the relevant passage from the Citing Decision that most strongly influences the signal. You also see the Reason for Signal? passage as the teaser text for that Citing Decision in the Shepard's report rather than the first reference to the Shepardized case.

When the Reason for Signal? is Subsequent Appellate History, clicking the link displays the treatment of your case, the case name, cite, court, and date of the document in the subsequent history. If the Reason for Signal? is generated by secondary appellate history, you see a message indicating that the history reference may not directly impact the case you are viewing. When you see that message, review the Appellate History in the Shepard's report.
