The Shepard's Alert® service on the Lexis+® service allows you to monitor a Shepard's® report to receive notifications of any changes to the report. Shepard's Alert continuously checks changes to the Shepard's Report, but you can customize the alert to receive updates for the types of changes you want to monitor. You can also use the Update Now feature on your Alerts page to view any updates instantly. 

Note: Update Now is only available for Shepard's Alerts.

There is no additional cost to set up a Shepard's Alert. You may incur additional charges when you click a link in the Shepard's report to a document that is outside of your subscription. If you have any questions about your LexisNexis® subscription, contact your LexisNexis Account Representative.

Creating a Shepard's Alert 


Take the following steps to create a Shepard's Alert while viewing a Shepard's report:

  1. Click Create an Alert to create an alert from a Shepard's report.
  2. Enter a title in the Title field if you want a different title for your alert. The title defaults to the citation you Shepardized.
  3. Click the Monitor tab.
  4. Select 1 of the choices under Monitor for. For more information about the options on the Monitor tab, see Monitoring Options for Shepard's Alerts below.
  5. Click the Deliver tab.
  6. Select the Duration, Frequency, Delivery type, Email Options, and Delivery format. For more information about the options on the Deliver tab, see Create a Shepard's Alert page below.
    Note: You must select Email + Online under Delivery type to see the Email Options and Delivery format.
  7. (Optional) Click the Share tab.
    Note: Some users do not have the option to share alerts. If you do not have the Share tab and would like more information about that functionality, contact your LexisNexis Account Representative.
  8. (Optional) Select the contacts with whom you want to share your alert and click Add to share. For more information about the options on the Share tab, see Create a Shepard's Alert page below.
  9. Click Create Alert.
  Note: Any filters you have applied to your Shepard's report prior to creating the Shepard's Alert are not considered in the monitoring of the report. The Shepard's Alert monitors the full unrestricted report.

Shepard's Alert Page Options 


Use the following table for additional information about fields and options available when you create a Shepard's Alert.

Tab Options
Overview Title: Enter a name for the alert you see in your list of alerts. The default entry is the name and citation of the citation you Shepardized.

Client: Select a Recent client or enter a New client to associate with your alert.

Monitor Monitor for: Select the type of change you want to be alerted for. For more information, see Monitoring Options for Shepard's Alerts below.
Deliver Duration: Select a Start and End date. The service defaults the range to the date you create the alert and 1 year from that date. You can select a range of 2 years.

Delivery type: You can select to view your results Online only or, if you prefer to receive email notifications in addition to viewing results online, Email+Online.

Email address: This field only displays when you select Email+Online. You can enter 1 email address in the field.

Frequency: This field only displays when you select Email+Online. Select how often you want to receive notification of new alert results by email. You can still check for new results online.

Email options: You can choose to receive notification every time the Shepard's Alert is run or only receive notifications when a change occurs.

Delivery format: You can choose to see the email in HTML format, which includes links to documents on the service, or plain Text format.

Share

Note:
Some users do not have the option to share alerts. If you do not have the Share tab and would like more information about that functionality, contact your LexisNexis Account Representative.
Enter a user's name: Enter the name of a user within your organization or email address of a user with whom you want to share your alert.

Added Contacts: This is the list of users with whom you shared this alert.

Monitoring Options for Shepard's Alerts 


Note: Monitoring options only monitor Citing Decisions.
 

Cases

  When you create a Shepard's Alert, you can choose one of the following monitoring options for cases:
  • Any Change - Alerts you to any change in the Shepard's report.
  • New Negative Analysis - Alerts you only when the service adds new negative analysis to the Shepard's report.
  • Custom Settings - Alerts you when specific treatments or headnotes change in the Shepard's report. The following settings depend on the citation you Shepardized, whether it is a case or a statute:
    • Negative treatment in Shepard's Report
    • Positive treatment in Shepard's Report
    • Other treatment in Shepard's Report
    • Change in Citing Reference Signal
    • All Headnotes
      Note: You can also select specific headnotes instead of all headnotes.
 

Statutes


Shepard's Reports for the USCS - United States Codes Service - Titles 1 through 54 and all state statutes include links to pending legislation and recently enacted legislation, if any. The following monitor options are available for statutes:

  • Citing references
  • Legislative history
  • Citing case signal
  • When pending legislation is added to the report
  • When pending legislation is finally enacted
  • When enacted law is codified

Note: A Shepard's Alert on a statute always retrieves pending and recently enacted legislation regardless of the Monitor options selected.
 

Additional Monitored Changes


In addition to the selection you make when creating a Shepard's Alert, the following changes are also monitored:
  • Shepard’s Signal™ indicator change of the cite you Shepardized
  • Subsequent History added
  • Prior History added
  • Prior History treatment change
  • Shepard's Signal indicator change of a citing reference
  • Citing reference removed
  • Headnote reference added to a citing reference
  • Shepard's Signal indicator change for a case in the Table of Authorities
  • Change in the legislative history of the statute you Shepardized and any changes to the pending or recently enacted legislation indicators for that statute
  • Pending legislation added to a Shepardized statute
  • Addition of a parallel citation to the case you Shepardized or a Citing Decision, including the replacement of a placeholder citation with a full report citation.
  • Change in the date of the cite you Shepardized, such as when the court amends or modifies the decision

Alert Email Delivery Times 


Alert email delivery times are based on the user's time zone. For shared Alerts, when the owner and recipient are in different time zones, the time at which the Alert result email is delivered is determined based on the owner's time zone (e.g., 9:00 am EST), and is converted for the recipient's time zone (e.g., 6:00 am PST).

If you selected to receive notifications on a monthly basis, the service delivers the notification on the date you selected. If the date does not occur in a certain month, the notification is sent the first day of the following month.

Viewing Alert Results 


You can access your full list of alerts from the Alerts bell icon at the top of any page.

Click Update Now to receive new changes to the Shepard's Report before you next scheduled notification. 

Note: The Alerts List shows the Updates indicator for the Shepard's Alert only if the service has identified changes in the Shepard's report.

A Shepard's Alert results list shows the list of changes over the last 30 days.

Both the email and the Alerts results online have links to the citing references that have changed in the report.

Table of Authorities 


The Shepard's Alert service includes a notification if the signal value of a cited reference inside the Table of Authorities report has changed. The Alert does not indicate that the signal change is from the Table of Authorities. The Alert labels the change as Cited document signal changed. The system automatically notifies you of the change, regardless of the options you selected for your Shepard's Alert. The service considers the notification of a change in the signal value of a cited reference inside the Table of Authorities report as a unique event for the Shepard's Alert.

 

The monitoring option for Change in Citing Reference Signal only applies to Citing Decisions. Whether this option is checked or not, the Shepard's Alert notifies the user if there is a change to the signal of a cited decision in the Table of Authorities references.
